Most of what goes wrong on Amazon in Europe is decided before the first listing goes live. The account is not a shop window; it is a contract between Amazon and a legal entity, and everything Amazon checks later — identity, tax, payments, product documents — is compared with what that entity declared on the first day. A seller who treats the opening as a form to get through quickly builds a file that contradicts itself, and the contradiction surfaces months later, at the worst moment, when the stock is already in a warehouse.
One entity, one account, and the European stores behind it
A single European seller account gives access to several European stores. Each store is a separate market: its own language, its own customers, its own category rules and its own tax treatment. The United Kingdom has had its own VAT and import rules since it left the Union, so treat it as another country and not as part of the same block. Amazon's rule is one account per business, with exceptions only on request and for a legitimate reason. What it verifies is the company: the business licence, the identity of the legal representative, the beneficial owners, an address, and a bank account or card in the company's name. A video call with the representative can be part of it. Every document has to say the same thing about the same company, down to the spelling of the name.
- The Chinese company as seller of record. The simplest structure and the most common. It means VAT registrations abroad are made by a company with no European presence, sometimes through a fiscal representative, and the payouts go to an account outside Europe. Nothing about it is forbidden; it only needs the tax part to be handled deliberately.
- A European entity or partner as seller of record. A local company, a local bank, local accounting, and a seller name that reads as European. It also needs a real company with real books, and a clear answer to who owns the stock and the brand. Do not open one only for the look of it.
- An agency or operator running the account. Acceptable if the account, the login email, the phone number and the payment method belong to your company and the operator works under a user permission. If they belong to the agency, the agency owns your business and you find out the day the relationship ends.
- Several brands. They go in one account, under the brands you can document. A second account to "separate" brands is the quickest way to be treated as a related account.
VAT: the country where the stock sits decides
The marketplace calculates the tax you have told it to calculate, and no more. It does not decide where you must be registered. The principle is physical: goods stored in a member state tie you to that state, and goods moved by Amazon's network from one state to another are a transfer of your own goods, which has a consequence at both ends. Pan-European fulfilment spreads stock across several countries unless you switch that off, which means a seller who ticked the default option has accepted tax positions in countries they never chose. The table below is a map of the situations, not a tax opinion.
| Situation | What happens with the VAT | What stays with you |
|---|---|---|
| Consumer sale through Amazon, stock inside the Union, seller established outside it | The marketplace is generally treated as the supplier to the consumer and collects the VAT | Your own sale to the marketplace, and in practice the registration Amazon asks for in each country where you store |
| Stock moved by the fulfilment network from one country to another | A transfer of own goods: a supply in one state and an acquisition in the other | Registration and reporting in both states, with the stock movement reports as evidence |
| Goods imported from China into a European warehouse | Import VAT is due at the border, and is recoverable only by the registered importer of record | Deciding who appears on the customs entry, and keeping the customs documents that support the recovery |
| Sale to a business customer with a VAT number | Not covered by the marketplace's collection: the sale is yours, with its own rules on exemption or reverse charge | A compliant VAT invoice, and checking the customer's number before applying any exemption |
| Sale to a consumer in the United Kingdom, Switzerland or Norway | Outside the Union's VAT system altogether, with national rules for each | A separate analysis per country before the first sale |
Two points complete the picture. First, the one-stop-shop scheme for distance sales reduces the number of returns for consumer sales across borders, but it does not replace the registrations tied to stock, and it does not cover business customers; the article on the scheme explains where it stops. Second, some member states require a business established outside the Union to appoint a fiscal representative, and whether they do depends on the state and on whether it has a mutual-assistance arrangement with your country. That is a question to put to an adviser registered in the state concerned, not one to settle from a forum. The sign you will see first is an Amazon notice asking for a VAT number before listings can stay active in a store.
Registrations that are not VAT but block listings the same way
Several member states run producer-responsibility registers for packaging, electrical and electronic equipment and batteries. The person who first places the product on that market has to be registered, pay the scheme and report the quantities. Marketplaces now ask for the registration number before a listing in a covered category can stay up, and Germany is the case most sellers meet first. Product safety works the same way: the rules ask for an operator established in the Union who answers for the product, named on it or on its packaging, and Amazon asks for that information per listing. None of this is tax. All of it ends the same way: a deactivated listing with a message that looks like a quality problem and is a missing document.
What actually triggers a suspension
- An identity that does not match. The name on the licence, on the bank account, on the card, on the identity document and in the account differ by a word, a translation or an abbreviation. The check is automated first, and a human only reads what the automation sends them.
- A link to another account. A shared device, network, bank account, address, phone number or payment card connects two accounts, including an old one that was closed. A closed account carries its history to every account it touches, which is why opening a replacement is the usual way to lose the second account as well.
- Complaints about rights or authenticity. A rights owner reports your listing, or a buyer says the product is not genuine. The complaint is acted on before it is examined, and paperwork showing where the goods came from is what answers it. The article on counterfeits describes what a rights owner looks at.
- Missing compliance documents. A category that requires a declaration, a test report or a responsible operator, listed without them. It tends to hit after a customer reports a safety problem, when the file is first asked for.
- Performance that the cross-border route makes likely. Late shipment, cancelled orders and "not as described" claims. When a seller ships from China with a delivery promise that the transit time cannot keep, Amazon reads the result as seller failure.
- Manipulation, real or apparent. Reviews from relatives or in exchange for a gift, changing an existing product page into a different product, grouping unrelated products as variations. The rules are strict, the sanctions are quick, and intention does not count.
The way back is written, not argued. A reinstatement request names the root cause, what was corrected, and what now prevents it from happening again, with documents that prove each of the three. It is short, factual and in English. It does not discuss whether Amazon was right. A rejected request can be followed by another, but one that repeats the same text is read as proof that nothing was understood. The root cause is often not where the notice points, and finding it means reading the account history, not the notice alone.
Before the first listing, settle four things in writing: which company is the seller and who signs for it; in which countries the stock will physically sit, with pan-European distribution switched on or off on purpose; who is the importer of record on each customs entry; and who is the operator established in the Union named for product safety. Then keep one folder per country with the VAT certificate, the producer-register numbers and the product documents, in a form you can send within a day. An account that can answer a verification request the same day is rarely suspended for long.
